Refund Policy
Please read this policy carefully before placing an order. This policy forms part of the Terms and Conditions. Capitalized terms have the meanings assigned there. References to the “First Party” and “Administrator” are as identified therein. By creating an account on galry.net, you agree to this policy. In the event of any inconsistency, the Terms and Conditions prevail.
Overview
- We want to be transparent about our refund position upfront. The nature of what we sell determines what is and is not refundable. Please read this policy before you purchase.
- Digital Articles are not refundable once access has been granted. Delivery is complete at the moment a file is made available to you, and the intellectual property cannot be returned once delivered.
- Physical Articles are custom, print-on-demand items. They are not refundable except in three specific circumstances: non-delivery, wrong item dispatched, or the item is materially not as described.
- All orders — digital and physical — are final and non-cancellable once placed.
Digital Articles
- Our Position:
- Digital Articles are non-refundable once access has been granted. By completing a purchase, you acknowledge that delivery occurs at the moment the file is made available — not at the moment you download it.
- This position exists because digital files cannot be returned once accessed. The intellectual property they contain is delivered in full the moment access is granted, regardless of whether you download, open, or use the file.
- The One Exception: Verified Technical Failure:
- If a technical failure on our end prevents you from accessing your digital Article entirely, and we are unable to remedy that failure, you are entitled to a full refund. To claim this:
- Contact us at acquisitions@galry.net within 14 days of the date on which access should have been granted (ordinarily within 5 days of order confirmation).
- We will attempt to resolve the issue within 7 days of receiving your request.
- If we cannot resolve it within that period, we will issue a full refund within 14 business days of confirming that a remedy is not possible.
- If we cannot agree on whether a qualifying technical failure has occurred within 14 days of your request, you may escalate to your payment processor, whose determination will be final and binding.
- If a technical failure on our end prevents you from accessing your digital Article entirely, and we are unable to remedy that failure, you are entitled to a full refund. To claim this:
- What Is Not Covered:
- The following do not entitle you to a refund on a digital Article:
- Buyer’s remorse or change of mind
- Failure to read the Article description before purchasing
- Choosing not to download or use the file after access was granted
- Dissatisfaction with the content of the Article after access
- The following do not entitle you to a refund on a digital Article:
Physical Articles
- Our Position:
- Physical Articles are custom, print-on-demand items produced specifically for you. They are not refundable except in the three circumstances described below.
- Because each item is made to order, we cannot accept returns for change of mind, and orders cannot be cancelled once placed. Please be certain of your purchase before you complete the checkout.
- Circumstance 1: Non-Delivery:
- If your physical Article does not arrive by the Expected Delivery Date, you may request a refund. The Expected Delivery Date is the earlier of: (i) the estimated delivery date in the carrier’s tracking information, or (ii) the date specified in your dispatch confirmation. If neither is available, it is 70 days from the date your order was dispatched.
- To claim a non-delivery refund:
- Submit a written request to acquisitions@galry.net within 14 days of the Expected Delivery Date.
- Requests submitted after this window will not be accepted.
- Please note: our dispatch records, including carrier tracking and documented package contents, constitute evidence of delivery. If tracking confirms delivery but you believe you did not receive the item, you will need to obtain written confirmation from the carrier acknowledging a delivery failure, misdelivery, or loss.
- Circumstance 2: Wrong Item Dispatched:
- If you receive an item that is materially different from what you ordered, you may submit a claim within 14 days of the delivery confirmation date. Please include photographic evidence of the discrepancy. Upon verification, we will either send you the correct item or issue a full refund, at our election.
- Circumstance 3: Materially Not As Described:
- If the Article you receive is materially different from its description on the Website, you may raise a claim under the same procedure as Circumstance 2 above.
- Please note that the following do not constitute grounds for a refund or wrong-item claim, because they are inherent to the print-on-demand process:
- Minor variations in size, colour, material, or finish that do not affect the Article’s intended purpose
- Differences between the item and any illustrative mockup, frame, or staging image shown on the Website
- Mockups and product images are for illustration purposes only and do not represent guaranteed exact physical specifications.
- What Is Not Covered:
- The following do not entitle you to a refund on a physical Article:
- Change of mind or buyer’s remorse
- Failure to review the Article description before purchasing
- Minor manufacturing variations that do not materially affect the item
- Delays that have not yet exceeded the Expected Delivery Date
- The following do not entitle you to a refund on a physical Article:
Cancellations
- All orders are final once placed. We do not accept cancellations for any reason, for either digital or physical Articles.
- Digital orders cannot be cancelled because the intellectual property is irrevocable once the file is accessible. Physical orders cannot be cancelled because production begins immediately and the item is made exclusively for you.
How Refunds Are Paid
- When a refund is approved, it will be processed within 14 business days. If that period cannot be met, we will notify you and provide a revised date.
- Refunds are paid using the same payment method used for the original purchase, where this is technically possible. If it is not possible (for example, because the payment method has expired or been closed), we will contact you to arrange an alternative.
- All refunds are net of any third-party transaction fees that are non-recoverable by us. Where this Agreement refers to a “full refund,” that means the amount paid for the Article net of such fees.
Chargebacks
- You have the right to raise a chargeback with your card issuer or payment processor in accordance with their rules and applicable law. We will cooperate with any chargeback investigation and provide relevant evidence.
- Please be aware that where a chargeback is raised in respect of a digital Article that was made available to you, and the chargeback succeeds on grounds for which no right of refund existed under this policy, the Extended License associated with that Article will be immediately revoked, and we reserve the right to pursue recovery of the amount through available legal means.
- Nothing in this policy is intended to discourage you from exercising legitimate chargeback rights.
Your Statutory Rights
- Nothing in this policy limits or excludes any right or remedy you have under mandatory consumer protection laws in your jurisdiction that cannot lawfully be excluded. Where any provision of this policy conflicts with such laws, that provision will be read down to the minimum extent necessary to achieve compliance. Your statutory rights are not affected.
